1. Acceptance of Terms
By accessing or using the Navigait platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. We reserve the right to modify these Terms at any time; continued use of the Service after changes constitutes acceptance of the revised Terms.
2. Description of Service
Navigait provides an AI-powered career and hiring platform, including candidate matching, assessments, and employer tools ("Navigait For Teams"). The Service is offered to individuals and organisations subject to these Terms and any applicable product-specific terms or subscription agreements.
3. Eligibility and Accounts
Student tools (Tracker, ESAT Prep, TMUA Prep) can be used without an account. Accounts and paid plans are for people aged 18 or over who can form a binding contract. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must notify us immediately of any unauthorised use.
4. Acceptable Use
You agree not to use the Service for any unlawful purpose or in any way that could damage, disable, or impair the Service or others' use of it. You may not attempt to gain unauthorised access to any systems or data, scrape or harvest data in violation of our policies, or use the Service to distribute malware or spam. We may suspend or terminate accounts that violate these terms.
5. Intellectual Property and Licences
The Service, including its design, software, and content (other than content you submit), is owned by Navigait or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, revocable licence to access and use the Service for its intended purpose. You retain ownership of content you submit; you grant us a licence to use, store, and process that content as necessary to provide and improve the Service.
6. Payment and Refunds
Paid plans are billed in accordance with the pricing displayed at the time of purchase. Fees are non-refundable except where required by law or as otherwise stated in your plan. We may change pricing with reasonable notice. Failure to pay may result in suspension or termination of your access.
7. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure. You use the Service at your own risk.
8. Limitation of Liability
To the maximum extent permitted by law, Navigait and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve months preceding the claim.
9. Governing Law and Disputes
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory consumer protection laws require otherwise.
